WI DOR Tobacco Tax Changes

Darling letter to congress regarding removing the RFG mandate.


COMM 10 is the state regulation affecting your tanks, piping and anything else related to fuel storage and distribution.  This rule is being revised by the Wisconsin Department of Commerce.

The Wisconsin Department of Commerce is the agency responsible for promulgating regulations associated with fire and workplace safety.  Chapter Comm 10 or the Flammable and Combustible Liquids Code applies to the storage, display, installation, operation, use, maintenance and transportation of flammable, combustible liquids including the equipment, facilities, and buildings that are used to store, transfer and dispense them.  The code contains requirements for retail outlets, agriculture, portable fuels, construction sites, marinas and more.  The transportation aspect of the rule applies to loading and unloading transport vehicles and transportation on facility grounds.

Given the complex nature of the code revisions, WPMCA formed a task force to perform a line-by-line assessment of the draft code.  WPMCA COMM 10 Taskforce members include:  Joe Gaspers-Midwest Fuels, Troy Batzel-Kwik Trip, Inc., Don Johnston-U.S. Oil Co., Inc., Mike Helgesen-Jacobus Energy, Jon Day-Jacobus Energy, Randy Meffert-Meffert Oil Co., Inc., Tom Reinsch-Condon Oil Company, Tim Clay-Wisconsin Federation of Cooperatives, WPMCA attorney Don Gallo and WPMCA Director of Government Affairs Matt Hauser. 

WPMCA encourages you to review the proposed rule as there are several significant code changes that may impact your businesses including but not limited to:

  • Retroactive requirements for liquid tight sumps under dispensers
  • Double-wall piping and tanks for new sites
  • Overfill alarms and auto-shutoffs at unattended sites
  • New inventory control standards
  • New record keeping requirements
  • Exclusion of clay liners or asphalt for secondary containment
